The complainant owns the trademark T-Online, and wanted to get the d-online.com back. Was it confusingly similar?
"The Panel realizes that the letter 'd', is relatively similar phonetically to the letter 't' in the English and German languages. The sound of 'd' is more similar to the sound of 't' than the sound of most of the other letters that form part of the domain names mentioned above. Visually there is however no particular similarity between the two letters, and the Panel thus finds that there is no extraordinary risk of confusing these two letters when used in domain names."
What an interesting statement! In the internet world, which is case sensitive, the arbiter takes into account the visual difference between two single letters. There is a difference between domain names law and dratemarks, oup, trademarks law!

Compare with turiocio.com: Por lo que respecta a la primera diferencia (el uso de una "i" en lugar de una "y" en el Nombre de Dominio), este Panel considera que la misma no debería constituir un impedimento para considerar el Nombre de Dominio y las marcas "TURYOCIO" confusamente similares. En este sentido, hay que tener en cuenta que fonéticamente no existe diferencia alguna entre la pronunciación en lengua castellana de la letra "i" y la letra "y", de modo que cualquier usuario podría fácilmente confundirse y escribir el término "Turyocio" con "i", especialmente si se tiene en cuenta el hecho que el mencionado término no tiene significado propio en lengua castellana. Así, una mínima diferencia como la que se da en este caso no debería considerarse suficiente como para considerar que existe un riesgo cierto de confusión entre el Nombre de Dominio y las marcas de la Demandante."
