When a panel doesn't have jurisdiction in a domain name dispute

Complainant, Cavalry Investments, LLC, hired Respondent, McCarthty Consultants, to retain the domain name cavalryinvestments.com for Complainant's use. Upon registration of the domain name, Respondent listed itself as the registrant, thereby preventing Complainant from securing the websites attached therein. When Complainant filed a Complaint under the UDRP, the Panel found that the dispute centered on a contractual issue as to the terms of their agreement and therefore the case was outside the scope of the UDRP. The Complaint was denied.
